Notaries traditionally recorded matters of judicial importance as well as private transactions or events where an officially authenticated record or a document drawn up with professional skill or knowledge was required.
In Australia, a Public Notary is a legal practitioner of many years standing appointed by the Supreme Court of the relevant state or territory. Generally, a Public Notary will be experienced in the drafting and execution of legal documents and have a sound working knowledge of Australian law and commercial practice.
A Public Notary undertakes many functions including:
- The preparation of international contracts, deeds, wills and powers of attorney
- Taking Declarations and Affidavits
- Noting and protesting of bills of exchange
- The preparation of ships' protests
- Witnessing and certification of documents for the purposes of recognition by foreign countries and their Embassies or Consulates
- Certification of original documents
- Verification of a person's identity
- Verification of acts by Corporations
- Obtaining an Authentication or Apostille from the Australian Department of Foreign Affairs and Trade
